Agreement to Terms

Welcome to PodForger. These Terms of Service ("Terms") govern your access to and use of PodForger's website, services, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

Please read these Terms carefully before using PodForger. If you do not agree to these Terms, you may not access or use the Service.

Description of Service

PodForger is an AI-powered podcast generation platform that enables users to:

  • Create automated podcast episodes from RSS feed content
  • Generate multi-speaker audio using AI text-to-speech technology
  • Customize podcast configurations including topics, voices, and schedules
  • Access and distribute generated podcast content
  • Subscribe to and listen to podcasts created by other users

Account Registration

To use certain features of the Service, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent to use the Service.

Subscription and Payments

Free and Paid Plans

PodForger offers both free and paid subscription plans. Free plans have limited features and usage quotas. Paid plans provide additional features and higher usage limits.

Billing

  • Paid subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We may change subscription fees with 30 days' prior notice
  • You are responsible for all applicable taxes

Minute Packages

In addition to subscriptions, you may purchase minute packages for additional podcast generation credits. Purchased minutes do not expire and are consumed according to our credit priority system.

Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until the end of your billing period.

Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Create, distribute, or promote harmful, illegal, or offensive content
  • Impersonate any person or entity
  • Spread misinformation or disinformation
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated systems to access the Service without permission
  • Attempt to circumvent usage limits or restrictions
  • Resell or redistribute the Service without authorization

Content and Intellectual Property

Your Content

You retain ownership of content you provide to the Service (RSS feeds, manual scripts, configurations, etc.). By using the Service, you grant us a license to use, process, and display your content solely to provide and improve the Service.

Generated Content

Podcast content generated by PodForger using your inputs and configurations is owned by you, subject to the following:

  • You are responsible for ensuring you have rights to use the source content (if provided by you)
  • Generated content may not be used to violate copyright or other rights
  • We reserve the right to remove content that violates these Terms

PodForger Intellectual Property

The Service, including its design, features, and technology, is owned by PodForger and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service without our prior written consent.

Third-Party Content and Services

The Service may process content from third-party RSS feeds and use third-party services:

  • We do not endorse or guarantee third-party content accuracy
  • You are responsible for ensuring you have rights to use source content
  • We can use AI services (OpenAI, Anthropic) subject to their terms of service
  • Payment processing is provided by Stripe, subject to their terms

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties regarding accuracy or reliability of AI-generated content
  • Warranties that the Service will be uninterrupted or error-free
  • Warranties regarding the accuracy of third-party content

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • PodForger shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim
  • We are not liable for content accuracy, availability, or third-party actions

Indemnification

You agree to indemnify and hold harmless PodForger and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

Termination

We may terminate or suspend your access to the Service:

  • For violation of these Terms
  • For fraudulent or illegal activity
  • For non-payment of fees
  • At our discretion, with reasonable notice

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will survive.

Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

  1. 1Informal Resolution: First, contact us to attempt informal resolution
  2. 2Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration
  3. 3Class Action Waiver: You agree to resolve disputes individually, not as part of a class action

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitute acceptance of the new Terms.

General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and PodForger
  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect
  • Waiver: Failure to enforce any right does not constitute a waiver
  • Assignment: You may not assign these Terms without our consent
  • Governing Law: These Terms are governed by applicable law
